- Police officers must certified before to administering roadside procedures known as Standardized Field Sobriety Tests. However, some officers patrol for DWI without receiving any training! We can fight your charges on this basis.
- You are not required to take the field sobriety tests, which include horizontal eye gaze, nine step walt and turn and the one leg stand tests, which are the only sanctioned tests in the State of Texas. They are completely voluntary. Furthermore, you are not required to submit to the Preliminary Breath Test which is usually administered by the officer on the roadside. Preliminary Breath Tests are not admissible as evidence of intoxication.
- We know how to question and request tests for the accuracy and calibration of Breathalyzers. The breath test machines must be calibrated regularly, or their finding can be ruled invalid. Futhermore, the procedure for administering blood tests is strictly statutorily defined.
- Police can only detain you for the time needed to investigate the charges that you were pulled over for. If you were pulled over for running a stop sign, for instance, police have limited time to investigate DWI suspicions.
